Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit

A lawsuit for disability claims by veterans could be the solution for a lot of veterans suffering from disabilities due to their military service. The Department of Veterans Affairs provides benefits to those who have served in the military, such as medical treatment and specialty programs.

However, getting those benefits is particularly difficult for Black veterans, as per a new lawsuit filed on Monday. The Yale Law School Veterans Legal Services Clinic filed the suit on behalf of Conley M. Monk Jr.

PTSD

PTSD symptoms can develop when traumatized people suffer. The symptoms can include anxiety, nightmares or troubling flashbacks. The condition can cause people to avoid certain locations or situations that bring back memories of the trauma. This can cause people to feel lonely and depressed. The good news is that PTSD can be treated with the help of counseling and medication as well as the support of family members.

A new lawsuit filed jointly by Black veterans and the Yale law clinics found that the Department of veterans disability lawsuits Affairs denied disability compensation claims for Black Veterans disability lawyers (Lamerpension.co.Kr) repeatedly over the course of decades. Quil Lawrence of NPR reports that a VA whistleblower notified the veterans that VA documents revealed that Black veterans were denied benefits in a higher proportion than their white counterparts.

The lawsuit was brought by Marine Vietnam veteran Conley Monk and Yale's Veterans Legal Services Clinic. It cites data showing that from 2001 to, the rate of rejection for Black disability claims was 29.5 percent, compared to 24.2 percent for white veterans.

The lawsuit seeks compensation for Monk and Black veterans who were wrongfully denied benefits. The lawsuit also seeks to force VA to review tens of thousands of other claims which were incorrectly denied. The lawsuit was filed this week in federal court.

Traumatic Brain Injury

TBI can be mild, moderate, or severe and symptoms may become evident or develop days or weeks after the injury. Some symptoms (headache, dizziness, fatigue) are physical, whereas others could be related to emotional, memory, concentration or behavior problems. TBIs can vary in severity, ranging from a concussion up to a coma. People who suffer from TBIs are at a higher risk of developing depression and PTSD and other mental health issues. Some research suggests that having several moderate to severe TBIs could increase the risk of developing dementia and movement disorders later on in life.

Post Traumatic Stress Disorder

Post traumatic stress disorder, or PTSD is a condition that occurs after people experience a trauma. The symptoms can start as soon as the event ends, or years later. They may include memory problems as well as difficulty getting sleep and concentrating, feelings of anger and irritability, and being easily frightened or jittery. Some people may experience depression or suicidal. The condition can cause problems at work, home, and in relationships. It can also trigger alcohol or drug addiction.

It is vital to see a doctor if you have PTSD. It is essential to address issues that impact your daily routine, like difficulties in relating to others, or feeling annoyed and frustrated. Self-help can be helpful for people suffering from PTSD. They could benefit from talking about their experiences in therapy or practicing relaxation exercises like deep breathing or a tempo-based exercise. They also benefit from being able to share their fears with a person they trust.

Depression

Depression is a condition that can cause feelings of sadness and despair. Psychotherapy is one option to treat depression. This involves talking to an expert about the issues you're experiencing. There may also be medications that can help boost your mood. There are a variety of therapy. Cognitive behavioral therapy helps you alter negative thoughts and behaviors while interpersonal therapy focuses on relationships. The lawsuit is being filed by Yale Law School’s Veterans Legal Services Clinic. Monk was represented in his successful effort to reverse his less-than honorable discharge from the military due to PTSD and other injuries.

The lawsuit claims that racial discrimination in the military justice system impacted the discharge status of Black service members and VA officials should have been aware of this when deciding on disability compensation. It cites research that discovered that between 2001 and 2020 the average denial rate for Black veterans disability lawyer who applied for disability compensation was 29.5 percent, as compared to 24.2% for white veterans.
