Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit

A veterans disability lawsuit could be a solution for many veterans suffering from disabilities due to their military service. The Department of Veterans Affairs provides benefits to those who have served in the military, including medical care and specialty programs.

According to a lawsuit filed Monday, Black veterans have disproportionately having a harder time getting these benefits. The suit was filed on behalf of Conley Monk Jr. by Yale Law School's Veterans Legal Services Clinic.

PTSD

PTSD symptoms can arise when traumatized people suffer. These symptoms could include flashbacks, nightmares, or anxiety that cause anxiety. This disorder can make an individual to avoid certain areas or situations that remind them of their traumatic experience. This can cause depression and isolation. Counseling, medication, and support from family members can treat PTSD.

A lawsuit that was filed jointly by Black veterans and Yale law clinics revealed that the Department of Veterans Affairs denied disability compensation claims for Black veterans consistently over the course of decades. Quil Lawrence of NPR reports that a VA whistleblower informed the vets that VA documents showed that Black veterans were denied benefits in a higher proportion than white veterans.

The lawsuit was filed by Marine Vietnam veteran Conley monk and Yale's Veterans Legal Services Clinic. The lawsuit cites statistics that show that from 2001 until 2020, the rejection rate for Black disability claims was 29.5 percent, compared to 24.2 percent for white veterans.

The lawsuit seeks compensatory damage for Monk and Black veterans who were wrongfully denied benefits. It also demands the VA to reassess thousands of other claims that were wrongly dismissed. The lawsuit was filed this week in federal court.

Traumatic Brain Injury

TBI can be mild, moderate or even severe and symptoms can be immediately apparent or they may develop hours or even weeks after the injury. Some symptoms are physical (headache dizziness, fatigue and headache) while others can be associated with issues with memory and concentration, emotional or behavior. TBI patients might also experience problems with movement or vision and balance.

TBIs can result from TBIs can be caused by TBI in the event that the brain has been damaged as a result of a blow or bump to the head. It can be caused by a blunt force, or from a penetrating injury (such as shooting). The impact may cause the skull to break, causing bruising and bleeding of the brain inside the skull. The brain can swell and press against the skull, causing blood circulation. The injury can affect the entire brain or a specific lobe of the brain.

Some TBIs can be classified as closed while others as open. The classification is determined by whether or not the skull has been broken and whether or not the skull was shattered or opened by the impact. TBIs can range in severity from a concussion up to a an coma. People suffering from TBI are at a higher risk of developing depression, PTSD and other mental health conditions. Research suggests that having multiple moderate to severe TBIs can increase the risk of dementia and other movement disorders later in life.

Post Traumatic Stress Disorder

Post-traumatic stress disorder (PTSD) occurs when an individual experiences a trauma. It can be apparent immediately following the event or years later. They could include memory problems trouble in concentrating and sleeping, feelings of anger and irritability and being easily scared or jumpy. Some people might suffer from depression or suicidal ideas. Stress can cause issues at work, in relationships and at home. It can also trigger alcohol or drug addiction.

The symptoms can be treated with psychotherapy, which includes eye movement desensitisation and Reprocessing (EMDR) or cognitive processing therapy. Antidepressants like selective Serotonin Reuptake Inhibitors (SNRIs) can be beneficial for those suffering from PTSD. These medications can help reduce symptoms and help people get through daily activities.

A few studies are looking at ways to prevent PTSD. This includes looking at whether genes and the brain can affect a person's response to a trauma. Others are investigating how a normal response to stress changes into PTSD and how to treat it in the early stages.

It is important to see a doctor if you have PTSD. The symptoms that hinder your everyday life, like difficulties getting along with people around you or feeling angry and upset must be addressed quickly. Some people with PTSD benefit from self-help like sharing their experiences in therapy or utilizing methods of relaxation, such as deep breathing or a rhythmic exercise. They may also benefit from being able to share their fears with someone they trust.

The following are some of the methods to lower the risk of developing a rash:

Depression is an illness that can trigger feelings of despair and sadness. Psychotherapy is one method to manage depression. It involves speaking with an expert about the issues you are experiencing. You may be prescribed medication to improve your mood. There are many different types of therapy. Cognitive behavioral therapy helps you change negative thoughts and behavior while interpersonal therapy is focused on relationships. There are group therapies which bring people with similar conditions together in a supportive environment.

The lawsuit claims that the VA has discriminated against Black veterans for a long time, by rejecting disability compensation claim at a higher rate than white veterans. Conley Monk is a Vietnam War veteran, who has been trying to get medical benefits including housing, education and housing benefits for more than 50 years. The lawsuit is being filed by Yale Law School's Veterans Legal Services Clinic. Monk was represented in his successful bid to overturn his less-than-honorable discharge from the military because of PTSD and other injuries.

The lawsuit says that racial bias in the justice system of the military affected the discharge status of a lot of Black service members, and VA officials should have known this when making disability compensation decisions. The lawsuit cites a study which found that between 2001 and the year 2020, the average denial rate for Black veterans who applied for disability compensation was 29.5 percent, compared with 24.2% for white veterans.
